By purchasing and using FindMyPhonePro ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not purchase or use the App. These terms constitute a legally binding agreement between you and Patrick (Sole Proprietor).

2. Service Description

FindMyPhonePro is an Android application designed to help users locate, track, and secure their own mobile devices through SMS commands, GPS tracking, remote camera capture, alarm override, and Google OAuth authentication. The App is provided as a digital download requiring a one-time license purchase of $19.99 USD for lifetime access.

Upon payment of $19.99 USD, you are granted a perpetual, non-exclusive, non-transferable license to use FindMyPhonePro on your Android device(s). This license includes:

• Lifetime access to the App
• Use on devices owned by you
• Access to all future updates and improvements
• Full access to all features including SMS tracking, alarm override, camera capture, and Gmail delivery

5. Payment and Pricing

The App requires a one-time payment of $19.99 USD, processed securely through our payment provider. All payment processing, tax calculations, and international compliance are handled by our processor.

The price is subject to change at any time. Existing customers will not be affected by price changes and retain full lifetime access at the price they paid.

6. System Requirements

FindMyPhonePro requires:

• Android device running Android 6.0 (Marshmallow) or higher
• Active SIM card with SMS capability
• GPS/location services enabled
• Camera permissions for remote capture features
• A Google account for OAuth sign-in and Gmail delivery

It is your responsibility to ensure your device meets these requirements before purchasing.

7. Prohibited Uses

You agree NOT to use FindMyPhonePro for:

• Tracking or monitoring another person's device without their explicit knowledge and consent
• Any illegal surveillance, stalking, or harassment activities
• Violation of privacy laws in your jurisdiction
• Any purpose that violates local, national, or international law
• Reverse engineering, decompiling, or attempting to extract the source code
• Reselling, redistributing, or sublicensing the App

8. User Responsibilities

As a user of FindMyPhonePro, you are responsible for:

• Keeping your 6-digit PIN private and secure
• Properly configuring the App with accurate Google account information
• Complying with all local laws regarding device tracking and surveillance
• Maintaining the security of your device and App settings
• Understanding and accepting the limitations of SMS-based device recovery

9. Permissions and Privacy

The App requires the following permissions to function:

• Location Services: For GPS tracking via SMS command
• SMS: To receive authenticated commands and trigger features
• Camera: For remote photo and video capture
• Device Administrator: To resist unauthorised uninstallation
• Google OAuth: For secure sign-in and private Gmail delivery

All data processing is performed locally on your device or sent directly to your registered Gmail. We do not collect, store, or sell your personal data. See our Privacy Policy for complete details.

10. Limitation of Liability

To the maximum extent permitted by law:

• FindMyPhonePro is provided "AS IS" without warranties of any kind
• We do not guarantee the App will recover your lost or stolen device
• We are not liable for any damages, losses, or theft of your device
• We are not responsible for data loss, privacy breaches, or misuse of the App
• Our total liability shall not exceed the purchase price ($19.99 USD)
• We are not responsible for any SMS charges incurred through use of the App

11. Service Availability

Because FindMyPhonePro operates primarily via SMS and on-device processing, it does not depend on our servers for core functionality. However, service may be affected by:

• App updates and maintenance
• Network carrier outages or SMS delivery failures
• Device hardware limitations
• Forces beyond our control

12. Updates and Modifications

Your lifetime license includes all future updates and improvements. We may add new features, improve existing functionality, fix bugs, or modify certain features with reasonable notice. Updates will be made available through our website and you are responsible for installing them.

13. License Termination

We reserve the right to terminate your license if you violate these Terms, use the App for illegal purposes, attempt to reverse engineer or redistribute the App, or if your use violates the rights of others. Upon termination, you must immediately cease using the App. No refund will be provided for termination due to violation of terms.

14. Intellectual Property

FindMyPhonePro, including all code, design, features, and documentation, is the intellectual property of Patrick (Sole Proprietor). Your license does not grant any ownership rights to the App. All rights not expressly granted are reserved.

15. Third-Party Services

The App integrates with Google OAuth and Gmail for sign-in and secure data delivery. We are not responsible for the performance, availability, or policies of these third-party services.

16. Governing Law and Disputes

These Terms of Service are governed by the laws of Kenya. Any disputes arising from these terms or your use of the App shall be resolved through good-faith negotiation first, followed by binding arbitration if necessary. By using the App, you agree to this dispute resolution process.

17. Changes to Terms

We may update these Terms of Service from time to time. Material changes will be communicated via our website. Continued use of the App after changes constitutes acceptance of the updated terms.
